Taxi Licensing & Appeals

Taxi and Private Hire Vehicles – Licensing & Appeals

To grant a taxi licence to you, the local Council must be satisfied that you are “a fit and proper person”.

The Council can suspend or revoke existing taxi licences if the driver is deemed to no longer be a fit and proper person.

These powers are strictly applied in order to ensure public safety and fair competition but sometimes unfairness results and operators, proprietors or drivers have their licences revoked or suspended, often with catastrophic effects on their livelihoods.

Before refusing a new application, or revoking an existing licence, your local Council will usually invite you to appear before a taxi licensing panel or sub-committee. That hearing is usually attended by a number of councillors and their legal adviser. Much like a court hearing, formal evidence will be called.

Representation at Committee & Disciplinary Hearings

We are experienced in representing our drivers when they are required by the council to attend committee hearings. We are often able to persuade the committee to divert from their strict guidelines which allows our drivers to keep their badges.

At Taj Mughal Solicitors we understand that appearing before a committee of councillors can be very daunting. We can help by obtaining details and statements of the evidence before the hearing and fully prepare you. We can also answer questions on your behalf if you prefer and submit evidence in your defence.

Appeals against committee decision to prevent,
revoke or suspend licence.

We can appeal to the court against the decision of the Local Licensing Authority on your behalf, build your case and represent you at the appeal before the Magistrate’s court and if required, the Crown court. At Taj Mughal Solicitors, we will always strive to advocate your rights and get you the best possible outcome.

Driving Offences as a Taxi Driver

Innocent taxi drivers can often find themselves accused of driving offences that can put their licence and job at risk.

This includes allegations:

  • Plying for hire
  • Refusing to take passengers
  • Driving without a badge or insurance
  • Assault and sexual assault

Some of the possible reasons for revoking or not
granting a license are listed below:

  • Not disclosing a criminal offence
  • Not disclosing a motoring conviction
  • Poor vehicle maintenance and safety issues
  • Significant customer complaints
  • Dishonesty
  • Other “bad conduct”
  • Being arrested or convicted of a criminal offence

We can help with the application and with all legal issues
relating to taxi licensing.

  • Police interview under caution
  • Ply for hire prosecutions
  • Police prosecutions
  • Taxi licence restrictions
  • Taxi licence committee hearings
  • Magistrates Court hearings
  • Magistrates Court appeals
  • Driving offences

Why Choose Taj Mughal Solicitors to represent you in your
taxi licensing case?

  • We have considerable experience of taxi licensing appeals across U.K and can help you throughout the process.
  • Even if you have convictions or cautions, or allegations made against you, this does not automatically prevent you from obtaining a taxi licence.
  • If you are accused of plying for hire (“touting”) or other breaches of taxi licensing regulations, we could also represent you. A conviction for touting could lead to the revocation or suspension of your taxi licence. It is therefore in your own best interest to seek legal advice as soon as possible.
  • Representing yourself can be difficult, particularly as the Council will be represented by a specialist Solicitor. They might try to rely on complex legal arguments, which would be difficult for an unrepresented driver to successfully argue against.
  • Call us for a free initial telephone consultation on 01782 914161 or send an initial enquiry via our website and we will call you.
  • We offer fixed fees, so you know in advance what you will need to pay and as a small business, we keep our prices competitive. Our specialist Solicitors will take into account all the factors of your case and provide you with a quotation in advance.
